NOTICE IS HEREBY GIVEN that the Board of Trustees of the Incorporated Village of Munsey Park will hold a Public Hearing on Wednesday, March 14, 2007 at 8:00 P.M. or as soon as possible thereafter, at the Village Hall, 1777 Northern Blvd., Manhasset, New York, for the purpose of considering the adoption of proposed Munsey Park Local Law #1-2007 entitled “A Local Law Establishing Stormwater Control and Erosion and Sediment Control in the Village of Munsey Park.”
The proposed local law would establish minimum stormwater management requirements and controls within the Village. The requirements therein would apply to land development activity, defined as construction activity including clearing, grading, excavating, soil disturbance or placement of fill that results in land disturbance equal to or greater than one acre, or activities disturbing less than one acre of total land area that is part of a larger common plan of development or sale. For those activities that fall within the scope of the local law, no application for approval may be reviewed until the applicant presents a Stormwater Pollution Prevention Plan, the requirements of which are detailed in the local law. The local law also sets forth the performance and design criteria for stormwater management and erosion and sediment control, including water quality standards and sets forth maintenance standards during and after construction. Compliance with these standards will be required for any preliminary or final subdivision approval or site plan approval. The Village will designate a Stormwater Management Officer to review all Stormwater Pollution Prevention Plans. To insure compliance with the local law, the Village may require posting of a performance bond, cash escrow or irrevocable letter of credit guaranteeing satisfactory completion of the project. The local law also sets forth penalties for violation of the standards in the local law. This local law is enacted pursuant to direction of the New York State Department of Environmental Conservation.
The proposed local law would take effect immediately.

A brief discussion and review was held on the proposed local law. Village Attorney James Bradley stated that the Village had not heard from the Nassau Planning Commission. Further, the Village should wait until next month to formally approve this local law and Local Law the local law regarding fees and deposits for zoning applications. The Board can close the hearing and informally voted on its adoption then adopt this local law formally at the April Board meeting.

NOTICE IS HEREBY GIVEN that the Board of Trustees of the Incorporated Village of Munsey Park will hold a Public Hearing on Wednesday, March 14, 2007 at 8:00 P.M., or as soon as possible thereafter, at the Village Hall, 1777 Northern Blvd., Manhasset, New York, for the purpose of considering the adoption of proposed Munsey Park Local Law #2-2007 entitled “A Local Law Amending the Code of the Village of Munsey Park to Prohibit Illicit Discharges.”
The proposed local law would regulate connections to the municipality’s separate storm sewer system (“MS4”) and regulate non-stormwater discharges to such system to the maximum extent practicable under federal and state law. The local law also establishes methods for controlling the introduction of pollutants into the MS4 in order to comply with the requirements promulgated by the DEC SPDES General Permit for such systems. The law establishes a Stormwater Management Officer to enforce the local law. It prohibits certain discharges into the MS4 and connections to the MS4 without a permit. Failing individual sewage treatment systems are prohibited. Activities contaminating stormwater and maintaining or using an unauthorized connection to the Village’s MS4 are prohibited. Where an illegal discharge or an activity contaminating stormwater occurs, the owner and other responsible persons would be required to implement best management practices to protect against and to reduce or eliminate the source of pollutants to the Village’s MS4 system. Any person subject to an industrial or construction activity SPDES stormwater discharge permit must comply with the provisions of the local law. The local law also establishes a system of penalties for violations of the local law and procedures for the Village obtaining injunctive relief to cease an illicit discharge. This local law is enacted pursuant to direction of the New York State Department of Environmental Conservation.
The proposed local law would take effect immediately.

NOTICE IS HEREBY GIVEN that the Board of Trustees of the Incorporated Village of Munsey Park will hold a Public Hearing on Wednesday, March 14, 2007 at 8:00 P.M. or as soon as possible thereafter, at the Village Hall, 1777 Northern Blvd., Manhasset, New York, for the purpose of considering the adoption of proposed Munsey Park Local Law #3-2007 entitled “A Local Law To Establish Fees and Deposits for Zoning Applications and Subdivision Applications.”
The proposed local law will authorize the Board of Trustees to establish and amend the schedule of fees and deposits for zoning applications to the Village, the Village Clerk, and the Village boards, departments, committees and commissions as the Village Board may deem appropriate. No applications to the Board of Trustees or the Board of Appeals may be processed unless all requisite fees and deposits, if any, have been provided. If during the application process, an additional fee or deposit is required, the processing of the application shall be stopped until such additional fee or deposit is received. The local law sets forth the mechanism by which the fees and deposits are to be paid. The deposit would cover the costs incurred by the Village in processing applications, to include advertising, stenographic minutes, the Village Engineer’s fee, planning, sound, traffic, environmental or specialized study or consultant’s fees, and legal fees for the Village Attorney, subject to the maximum number of hours as set forth in the local law. The local law will not affect any obligation set forth in any other Chapter of the Village Code to pay fees or to provide for the payment and recovery of any direct or indirect costs and expenses of the Village.
The proposed local law would take effect immediately.

NOTICE IS HEREBY GIVEN that the Board of Trustees of the Incorporated Village of Munsey Park will hold a Public Hearing on Wednesday, March 14, 2007 at 8:00 P.M. or as soon as possible thereafter, at the Village Hall, 1777 Northern Blvd., Manhasset, New York, for the purpose of considering the adoption of proposed Munsey Park Local Law #4-2007 entitled “A Local Law To Require a Deposit or Bond to Cover Damages to Village Roads, Trees or any Village Property During Construction.”
The proposed local law would require, for any work where a permit is issued under Chapter 87, and the work is new construction or the cost of construction exceeds a specific sum, or the alterations or additions to buildings exceeds 750 square feet, the owner must deposit with the Village Clerk such sum as to be determined by the Board of Trustees to be used to cover any damage to the Village roads, the Village trees, or any Village property by the owner’s contractor or any other person, firm or corporation who is doing the work for which the permit is issued. The Village may withdraw such sums from the deposit, as it deems necessary in its reasonable discretion to pay for the repairs of such damage. The local law lays out the manner in which the deposit may be made.
The proposed local law would take effect immediately.

POND AND ROAD CONSTRUCTION
Richard Gibney, village arborist, presented a plan for the renovation of Copley Pond. Among the ideas featured were plantings to discourage the gathering of Canadian geese. Mr. Gibney felt these birds have exacerbated the erosion of the pond in the last six years. The Board is seeking funding for the renovation from private grants as well as government sources. Therefore, it is not expected that the work will begin this year. The project has been divided into stages so that as funding is available, each phase will be completed.
Mayor Nicolaides reminded everyone that Mr. Gibney is available to village residents as a consultant. There is no fee for this service.
Ken Pritchard, representing the firm of Dvirka and Bartilucci, gave the Board an update on the road construction. The roads that are scheduled to be repaved and repaired have been divided into three groups. Bids will be sent out for each group. It is hoped that work will begin as soon as the weather permits on one of the groups, with the others to be handled in due time.
TREE PLANTING, PRUNING AND REMOVAL BID
The lowest bid for 2007 tree work was $19,200 from Hefferin Tree and Landscape Contracting Inc.; Harder Services Inc. was second with a bid of $20,790 followed by The F.A. Bartlett Tree Expert Co., at $31,218.50 and Davey Tree Expert Co. at $35,750.
Richard Gibney Village Arborist recommends that the Board award the bid to Hefferin Tree and Landscape Contracting Inc., the low bidder.
